Planning Board minutes for Thursday April 13, 2017

Open meeting and take attendance.
1. The meeting opened at 7:07 p.m.
2. Members present: Pat Salomon, Roger Tryon, Larry Klein, Richard Piepho. Members absent: Stephen Enoch, Tom Sawyer
3. Public present: Don Coburn, John Szablowski and Kip Strawbridge from Hume.
The board read the minutes from 3-23-2017, 3-29-2017, and 4-6-2017; all were approved as written.
Remaining business for Hume site plan review.
John Szablowski stated that he read the site plan review approval with conditions and had the following questions and comments.
The site plan approval with conditions will be read by the Hume legal team for acceptability and legality.
What, if any, is the appeal process?
The condition of the police detail is too vague and seems onerous. Can that be changed?
Hume requested a clarification about the conditions for outdoor amplified sound and is “disheartened by them.”
Planning Board member Roger Tryon stated that he did not vote for the condition for the police detail.
Planning Board members Richard Piepho and Larry Klein agreed that it was too broad and possibly illegal.
John Szablowski/Hume requested that the Planning Board make some clarifications and left the meeting.
Klein requested that he be allowed to abstain from the discussion because he did not vote for the conditions.
The board began to work on clarifications only to decide, almost immediately, that clarifications can actually be amendments and that we don’t know if we can change items that have been approved by the board. Board members agreed that if we can find the legal support for reconsideration we will respond accordingly. Leonard said that she would check and see if the land use lawyer, Mark Bobrowski, could help them with the process to make changes.
The meeting adjourned at 9 p.m.
